By signing up for this payment plan for the Mining Claim “Sanger Placer #1” You are agreeing to the following terms,
Purchase and payment schedule
- The total purchase price of this claim is $4499
- This price will be paid in 4 equal payments of $1124.75
- Each payment will automatically be withdrawn from the debit or credit card you use to pay your first payment.
- Each monthly payment will be withdrawn on the same day of the month that you made your first payment. IE if today is the 5th, your monthly payments will be on the 5th.
Title Remains with Seller
Seller retains full legal title and ownership of the Claim until the entire Purchase Price has been paid. No quitclaim deed or other transfer document will be signed or recorded, and no transfer of interest will be filed with the BLM, until Seller has received the full Purchase Price in good funds.
Temporary License Only
Until the Purchase Price is paid in full, Seller grants Buyer a personal, non-transferable, revocable license to enter the Claim solely for casual-use prospecting (pans, sluices, highbankers, metal detectors). Buyer may not:
- Conduct commercial or large-scale mining
- File any BLM plan of operations or notice
- Assign or sub-license the rights
- Place permanent structures or equipment
- Suction dredge
- Camp for more than two weeks at a time.
This license is not a lease, not an ownership interest, and creates no equitable title.
Default and Termination
Buyer is in default if any payment is more than 15 days late. Upon default:
- This Agreement and Buyer’s temporary license terminate immediately.
- Seller may keep all payments previously received as liquidated damages.
- Buyer must immediately cease all activity on the Claim and remove any personal property.
- Seller may resell the Claim without further obligation to Buyer.
If an automated payment is attempted and failed or the buyer wishes to change their card on file, it is the buyers responsibility to contact republic mining at republicmining@yahoo.com to reestablish automated payments.
Responsibilities During the Agreement
- Seller remains the BLM claimant of record and is responsible for the annual maintenance fee (or small-miner waiver) while the Agreement is in effect.
- Buyer is responsible for any damage, environmental issues, or claims arising from Buyer’s activities.
- Buyer shall indemnify and hold Seller harmless from any liability related to Buyer’s use of the Claim.
Transfer Upon Full Payment
Upon receipt of the full Purchase Price, Seller will execute and deliver a quitclaim deed and cooperate with the filing of a transfer of interest with the BLM. Buyer will then become the sole owner and will be responsible for all future fees and obligations.
As-Is
Buyer accepts the Claim in its current “as-is” condition with no warranties regarding mineral value, access, water rights, or suitability.
Governing Law
This Agreement is governed by the laws of the State of Oregon. Any disputes shall be resolved in the state or federal courts located in Josephine County, Oregon.
Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior discussions.
